Using Microsoft 365 would be in breach of EU privacy legislation, GDPR. This is the opinion of a working group consisting of federal and state privacy supervisors in Germany.
In a statement, German authorities allege several objections to German organizations’ use of Microsoft 365. These include the ability for US authorities to request data from European users. Another reason is Microsoft’s own notice on data processing, which does not provide sufficient explanation about data processing for its own purposes. For example, the Microsoft 365 User Agreement states that Microsoft may use end-user data for commercial purposes.
The statement currently only represents an assessment of the situation and therefore does not lead to a direct execution. It is unclear if and when the supervisory authorities’ assessment will be converted into a political measure.
The German decision closely follows the French government, according to which the free offers of Microsoft 365 and Google Workplace cannot be used in French schools. French public institutions must provide agreements on payments to the supplier, says the French Ministry of Education and Youth. According to the latter, the free ‘cloud’ offers from Microsoft and Google are akin to dumping.
